The meeting, held on Thursday, April 23, 2026, centred on improving the efficiency of judicial processes that support access to credit and financial stability.
The delegation, led by the Association’s President, Mr. John Awuah, also used the opportunity to congratulate the Chief Justice on his appointment and assumption of office.
Strengthening Credit and Judicial Collaboration

Mr. Awuah highlighted the critical role of the Judiciary in supporting access to credit, noting that a robust financial system depends on an efficient justice system that enables lenders to recover funds from defaulters.
He raised concerns over legal challenges encountered in loan recovery, particularly the use of tactical court filings by some borrowers to delay or prevent foreclosure proceedings. He further noted that pegging reserve prices above forced-sale values can hinder asset recovery, creating operational difficulties for banks.

In response, the Chief Justice acknowledged these concerns and clarified that the Judiciary does not shield defaulters but operates within the principles of natural justice, which require that all parties be heard before decisions are made. He encouraged banks to review their internal processes to address some of these challenges and suggested profiling cases to determine which matters are better suited for arbitration rather than litigation.
Judicial Insights for the Banking Sector
Judges from the Superior and Lower Courts present at the meeting provided insights into key legal provisions affecting the banking sector, including aspects of the Borrowers and Lenders Act, garnishee proceedings, and other relevant court directives.
The discussions also highlighted the need for clearer practice directions on account preservation orders to ensure consistency and mutual understanding. The Chief Justice indicated that a review of the court rules is currently underway and encouraged the Association to submit proposals to the Rules of Court Committee for consideration.

Call for Support for Anniversary Projects
The Chairperson of the Supreme Court at 150 Anniversary Committee, Justice Richard Adjei- Frimpong (JSC), appealed to the Association to support the Judiciary’s legacy projects, including the construction of modern court facilities in Tema and Cape Coast. He noted that these initiatives would benefit both the banking sector and the broader public.
